The majority of individuals are uncertain about the legality of hemp goods. One could ask, “Is Delta-9 THC legal in Hawaii?”.

Yes! In Hawaii, Delta-9 which has been derived from hemp is permitted.

When the 2018 Farm Bill was approved, all cannabinoids and goods made from hemp, including CBD, Delta 8 THC, and Delta 9 THC, were made legally available on a national level.

With House Bill 2689, Hawaii joined a large number of other states in making hemp products legal.

Hawaii House Bill 2689

In 2020, shortly after the Farm Bill was approved by the US Congress in 2018, Governor David Ige signed House Bill 2689 into law, separating hemp from marijuana and legalizing some hemp products.

The Law approved Hawaii’s commercial hemp farming and processing. The Hawaii Department of Agriculture was mandated by the law to issue licenses and enforce regulations for hemp in Hawaii.

In March 2021, the Hawaii Legislature passed two significant cannabis-related laws. Senate Bill 767 legalized marijuana and authorized businesses with a license to cultivate, produce, and market cannabis products. Additionally, the measure permitted the cultivation of up to three mature plants.

Medical Marijuana in Hawaii

Hawaii became the first state to legalize medical marijuana by legislation in 2020, as opposed to a voter proposal. Governor Ben Cayetano of Hawaii signed Act 228 into law in 2000, allowing holders of medical cannabis cards to grow their marijuana or choose a caregiver to do so.

According to Hawaii state regulations:

Patient possession limits: At any given moment, the eligible patient and the primary caregiver may share four ounces of usable marijuana.

The plant’s seeds, stalks, and roots are excluded from the definition of “usable marijuana”. Seven marijuana plants, mature or immature, are the maximum number that may be grown at home.

Qualifying for the medical marijuana program: To be eligible for a 329 card in hawaii, a patient must have a medical qualifying condition and a prescription from a Hawaii doctor or advanced practice registered nurse who has the authority to prescribe that the “potential benefits of the medical use of marijuana would likely outweigh the health risks for the qualifying patient.”

In March 2022, the Hawaii Senate Health Committee passed Senate Bill 2718, which modified the definition of “qualifying patient” to extend access to medical marijuana given its many benefits. The bill made it easier for seniors (those 65 and over) to participate in the state’s current medical marijuana program.

For recreational use, marijuana is prohibited in Hawaii, but possession of three grams or less is not a crime.

Hawaii residents can buy Delta 9 online, retailers and from vape shops. They can also purchase directly from the manufacturer’s website.

Avoid buying Delta-9 products from unlicensed vendors, including random people you meet online, on social media, or in forums. Buying a fake product carries a considerable amount of risk. So always buy D9 products from the authorized vendor.

The current law permits the use of Delta 9 THC in Hawaii. Now you can buy D9 THC products online without any fear of getting yourself in legal trouble.
