As of today, more than half of the US states (38 to be exact) have an active Medical Marijuana Program allowing qualifying patients to possess and consume Medical Marijuana-based products. As per the majority of the state laws, you’re eligible to apply for a Medical Marijuana Card if you’re 21 or older and qualify with other state-specific prerequisites. However, patients under the age limit of 18 are obligated to have a caregiver or else they can’t possess Medical Marijuana.

It is also recommended to have a caregiver if you’re too ill to get your own Medical Marijuana from a state-authorized dispensary. Interestingly, the qualifying conditions, application procedure, and processing fee for caregivers vary from state to state.

  • Ensuring renewal of the patient’s Medical Marijuana Card in time.
  • Growing Marijuana for the patient or buying it from an authorized dispensary.

Requirements for Becoming a Medical Marijuana Caregiver

The exact requirements to become a Medical Marijuana Caregiver vary from state to state, however, an overview of the general requirements that are a must for almost every state can be taken through the following table,

ALABAMA

Caregiver’s Qualifications

  • Must be a state resident.
  • Must be registered with the Alabama Medical Cannabis Commission (AMCC).

  • Can serve as a caregiver for a maximum of three patients.

ARIZONA

Caregiver’s Qualifications

  • Be at least 21 years old.
  • Cannot have served a minimum of 10 years in prison for a violent or drug-related crime that did not result in a conviction under the Medical Marijuana Act.

Application Fee

The application fee for a designated caregiver’s initial or renewal registry identification card in Arizona is $200. Each caregiver must apply for a new card for every patient they care for, up to a maximum of five patients.

ARKANSAS

Caregiver’s Qualifications

  • Be at least 21 years old.
  • The patient must be physically incapacitated, a minor, or both based on the doctor’s written certification form.
  • The patient must possess a valid medicinal marijuana card.
  • No felony convictions are excluded from the criminal background check (except for parents of minor qualifying patients).

Application Fee

The application fee for designated caregivers to adult patients is $87, which includes the application processing fee and criminal history application fee. Additionally, caregivers must pay $50 for each registry card for each patient they are caring for, or $50 for caregivers to minor patients (where the criminal background check is not required).

CALIFORNIA

Caregiver’s Qualifications

  • Take responsibility for the patient’s housing, health, or safety.
  • It can be an individual or an appropriately licensed clinic, facility, hospice, home health agency owner, operator, or employee.
  • Must be 18 years old and above.

Required Data

  • Digital photos are taken at the time the patient submits their application.
  • Identification, such as a driver’s license issued by the California Department of Motor Vehicles, a
  • California identification (ID) card, or another government-issued photo ID.

Application Fee

The application fees for an MMIC (Medical Marijuana Identification Card) in California vary by county. Applicants need to contact their county’s program to find out the specific fee charged for an MMIC application. The fees can go up to $100 per MMIC application or renewal and up to $50 per card for Medi-Cal eligible applicants. Participants in the County Medical Services Program are exempt from these fees. If the patient applicant is a Medi-Cal beneficiary, their primary caregiver’s card fee will be discounted by 50%.

COLORADO

Caregiver’s Qualifications

  • Be 18 years old or older.
  • Be a Colorado resident.
  • Not be the patient’s physician.
  • Not have their primary caregiver.
  • Not be licensed as a medical marijuana business.

HAWAI

Caregiver’s Qualifications

  • Be at least 18 years old.
  • Agree to undertake responsibility for managing the well-being of the qualifying patient concerning the medical use of cannabis.
  • Only one caregiver is permitted for each patient.
  • Caregivers may only have one patient at any given time.
  • Minor patients are required to have a caregiver.
  • Up to two caregivers may be registered for a minor patient if both primary caregivers are the parents, guardians, or persons having legal custody of the minor patient.
  • After December 31, 2023, caregivers will not be allowed to grow medical cannabis except for minors/adults lacking legal capacity or on islands without a dispensary.

ILLINOIS

  • Undergo a background check conducted by the Office of Cannabis Policy (OCP) in the past 12 months.

MARYLAND

Caregiver’s Qualifications

The application fee for obtaining an ID card as a caregiver in Maryland’s Medical Cannabis Program is $25. In the case of a replacement card, the fee is $100.

MASSACHUSETTS

Caregiver’s Qualifications

  • Be 21 years of age or older.
  • Upload a state-issued driver’s license or government-issued ID as proof of identification.
  • Provide a document showing their primary residence.
  • Submit a passport-style photograph with specific requirements (square format, colored, recent, plain white background, showing only head and shoulders).

MICHIGAN

  • Not previously held a license, identification card, or other state-issued document participating in the medical marijuana program in Mississippi or any other state that has been subsequently revoked by the state authority for the medical marijuana program.
  • Be in good standing if possessing a professional license.

The application fee for becoming a caregiver in the Mississippi Medical Cannabis Program is $25, which is non-refundable. Additionally, there is a $37 nonrefundable fee for the criminal background check.

MISSOURI

Caregiver’s Qualifications

  • Be 21 years of age or older.
  • Responsible for managing the well-being of a qualified patient.
  • Designated by the qualified patient on the primary caregiver’s application for an identification card or in other written notification to the Department.
  • Authorized by the qualified patient to purchase and possess marijuana on their behalf.
  • Authorized to cultivate medical marijuana plants on behalf of the qualified patient.
  • For minor patients, only their parents/legal guardians are eligible to act as their licensed caregivers, and a Parental/Legal Consent Form must be signed during the application for the minor patient’s application.

NEVADA

Caregiver’s Qualification

Anyone may act as a caregiver to a medical marijuana patient if they are at least 18 years old and have their doctor’s permission.

For a minor who is responsible for medical decisions, authorization from their guardian or custodial parent is required, and the parent or guardian must serve as the minor’s main caregiver.

There is no additional fee for the caregiver application in Nevada.

NEW HAMPSHIRE

Caregiver’s Qualifications

  • Must be designated as a caregiver on the patient’s application, and the patient must be approved for the Program.

Required Data

  • Caregiver Application Form sent to the New Hampshire Department of Health and Human Services (NH DHHS).
  • For minors, use the Minor Patient Application (combined patient/caregiver application).
  • For adults applying as legal guardians and caregivers, use the Guardianship Patient Application (combined patient/caregiver application).

There is no application fee for caregivers to apply or renew.

NEW JERSEY

  • Caregiver’s Qualification
  • Be a New Jersey resident.
  • Be at least 18 years old.
  • Pass a background check (only non-immediate family members).

Required Data

Caregivers must be designated by the patient on their application.
For non-immediate family members or caregivers, fingerprint submission is required for a criminal background check.

$50 – Standard caregiver application fee.
$20 – Reduced caregiver application fee.
Free caregiver application fee for parents and legal guardians of minor patients.

NEW MEXICO

Caregiver’s Qualification

  • Be a resident of New Mexico.
  • Be permitted to obtain and transport medical cannabis from a licensed nonprofit to the qualified patient.
  • Be able to produce medical cannabis at the designated licensed location identified on the personal production license.

  • Completed “Primary Caregiver and Patient Information Form” (Page 1).

There is no charge to apply for a Primary Caregiver ID Card in New Mexico

NEW YORK

Caregiver’s Qualification

  • Must be designated by a registered patient with the New York medical cannabis program during the patient registration process.
  • Must create a personal account on the official New York State portal and register as a caregiver after the patient’s registration is approved by the New York Office of Cannabis Management (OCM).
  • Must be at least 21 years old (for cultivation of cannabis at home on behalf of patients under 21 or with physical/cognitive impairments).
  • Must have a valid registry identification card issued by the Medical Cannabis Program.

NORTH CAROLINA

As of 2023, the state doesn’t have a Medical Marijuana Caregiver Program.

NORTH DAKOTA

Caregiver’s Qualification

  • Must complete the designated caregiver application via the North Dakota BioTrackTHC system.
  • Must provide the required general information data fields, including name, date of birth, address, phone number, and email address.
  • Must enter the patient’s 10-digit alphanumeric barcode number and verify the match to the designated caregiver.

Required Data

  • Photo of the applicant (full face in view on a white background).
  • Copy of the front of the applicant’s North Dakota state-issued driver’s license or non-driver identification card.
  • Criminal history record checks with the initial application and every two years thereafter.
  • Must not have been convicted of a drug misdemeanor within the five years preceding the application date or of a felony offense ever.

Application Fee

There is no application fee for designated caregivers. However, all fees associated with the criminal history record check must be paid by the applicant.

OHIO

Caregiver’s Qualification

  • The recommending doctor or physician delegate must register the patient and their caregivers with the Ohio Medical Marijuana Patient & Caregiver Registry.
  • Patients under the age of 18 are required to have a parent or legal representative serve as their caregiver.
  • Caregivers must be eligible and verified by the Ohio Medical Marijuana Control Program Board staff before being accepted as a registered caregiver in the program.
  • Caregivers must activate their registration and pay the required fee to become eligible to buy medical marijuana on behalf of a patient.

Required Data

  • Caregivers need to provide their information and complete the registration process in the Ohio Medical Marijuana Patient & Caregiver Registry.
  • The caregiver’s eligibility and status will be checked by the program staff, and they will be notified via email when their status has been granted.
  • The caregiver needs to bring their activated Registry card and a government-issued photo ID to a dispensary to purchase medical marijuana on behalf of the patient.

Application Fee

The caregiver registration fee is $25.

OKLAHOMA

Caregiver’s Qualification

  • Caregiver licenses are available to family members or assistants who regularly look after a medical marijuana patient.
  • Patients must have their physician certify the need for a caregiver on the Physician Recommendation Form.
  • Caregivers and patients must complete the Caregiver Designation Form to establish the patient-caregiver relationship.
  • Only patients with a certified medical need for a caregiver may have a licensed caregiver.
    Being a minor alone does not qualify an applicant for a caregiver license.

  • Caregiver applicants need to provide proof of identity, such as an Oklahoma driver’s license or Oklahoma identification card (front and back).

OREGON

Caregiver’s Qualification

  • Caregivers must be at least 18 years old.
  • They cannot be the patients’ regular medical practitioners.
  • The primary caregiver for a minor using medical marijuana must be a custodial parent or legal guardian.

Required Data

Government-issued ID is required for caregiver applicants.
If the patient is a minor, a notarized Declaration of Person Responsible for a Minor form is required, signed by the minor’s custodial parent or legal guardian responsible for the minor’s health care decisions.

Application Fee

There is no separate application fee for caregivers. However, caregivers are part of the Patient Basic Application, which costs $200.

PENNSYLVANIA

Caregiver’s Qualification

  • Caregivers must be at least 21 years old.
  • They must be a Pennsylvania resident.
  • Caregivers should have a valid Pennsylvania driver’s license or state-issued ID card with the current address.
  • Completing a criminal history background check is required.
  • Caregivers must not have been convicted of a criminal offense related to the sale or possession of drugs, narcotics, or a controlled substance in the last five years.

Required Data

  • Caregivers should provide personal information and complete the application through the state’s online portal.
  • Each caregiver account in the Patient and Caregiver Registry requires a unique email address.

Application Fee

The cost of a medical marijuana ID card for caregivers is $50. Fee reductions may be available for patients participating in assistance programs such as Medicaid, PACE/PACENET, CHIP, SNAP, and WIC.

RHODE ISLAND

Caregiver’s Qualification

  • Caregivers must be at least 21 years of age.
  • Primary caregivers must be residents of Rhode Island, while authorized purchasers may live out of state.
  • Proof of residency, such as a copy of a Rhode Island Driver’s License, Rhode Island State ID, or vehicle registration, must be provided.
  • Caregivers must not have committed various felony charges, not limited to felony drug convictions.
  • A National Criminal Identification Check must be satisfied.

Required Data

The Patient Application Form includes information on caregivers, background checks, and application fees.
For applicants who are minors, a Minor Form must be completed, signed, and submitted along with the Patient Form.

Application Fee

As of December 1, 2022, there is no application fee for registering as a caregiver or patient. However, there is a $10 fee for a change of information and a $10 fee for a replacement of a lost or stolen card.

SOUTH CAROLINA

SOUTH DAKOTA

Caregiver’s Qualification

  • Caregivers can only start the medical cannabis application process after the patient completes their application process.
  • All minor patient applications require caregivers to be registered.
    Caregivers must have a valid South Dakota driver’s license, passport, tribal identification card, or SD Student ID card.
  • A valid passport-style photo of the caregiver with a plain white or off-white background is required to create the caregiver’s registration ID card.
  • Caregivers must answer questions used for internal background check verification purposes, including residency and any alternate names used in the past.
  • A Division of Criminal Investigation fingerprint card and an authorization and release form to local law enforcement are also required.

Application Fee

For the issuance of any caregiver registration identity card, eligible patients must pay an additional $20 cost. There is no fee for the designation of a caregiver at the time of the initial or renewal application.

Caregiver’s Qualification

  • Must be added as a caregiver by the patient during the patient’s application process.
  • Must register and create a Utah ID account in the electronic verification system (EVS).
  • Provide patient and caregiver’s complete names, dates of birth, addresses, gender, and last 4 digits of the caregiver’s Social Security Number.
  • The caregiver’s proof of identity is required.

  • Patient and caregiver’s dates of birth.
  • Patient and caregiver’s addresses.
  • Patient’s gender.
  • Caregiver’s last 4 digits of the Social Security Number.
  • Caregiver’s email address.

  • Caregiver’s proof of identity.

Application Fee

  • $68.25 for the caregiver card (primary patient initial).
  • $15 for the caregiver card (secondary patient initial).
  • No charge for the caregiver card (first renewal).
  • $14 for the caregiver card (primary patient subsequent renewals).

VERMONT

Caregiver’s Qualification

  • Must be a Vermont resident.
  • Must be over the age of 21.
  • Agrees to manage the well-being of a registered patient concerning the use of medical cannabis.
  • Can go to the dispensary and receive deliveries for the patient.
  • Can assist with cannabis cultivation.

Required Data

  • Valid Vermont Driver’s License or non-driver ID number.
  • Authorization for Dispensary communication and delivery.
  • A digital photo in color, taken within the last 6 months, showing full face and shoulders facing the camera.

Application Fee

  • $50 – Registration Fee
  • $30 – Fee for processing the criminal background check request.

VIRGINIA

Caregiver’s Qualification

  • Can be designated by a patient or the patient’s parent or legal guardian.
  • Registered agents must apply for registration with the Board of Pharmacy before obtaining medical cannabis oil on the patient’s behalf.
  • Must present a valid Written Certification for the Use of Medical Cannabis from a Registered Practitioner for Medical Cannabis to obtain medical cannabis products.

Required Data

Proof of residency of the agent (government-issued ID card or tax receipt).
Proof of identity of the agent (government-issued identification card).
Proof of the qualifying agent’s age (birth certification or other government-issued identification).

Application Fee

  • $25 – Initial registration fee for a registered agent.
  • $25 – Annual renewal fee for a registered agent.
  • $50 – Optional registration card for the parent or legal guardian.

WASHINGTON

Caregiver’s Qualification

  • Must be 21 years of age or older.
  • For minor patients, the designated provider is typically the parent or legal guardian.
  • For adult patients, joining the medical cannabis authorization database is voluntary, and the patient may choose a designated provider.

Required Data

  • Each patient and designated provider must have their medical cannabis authorization form issued by the patient’s health care practitioner.
  • The parent or legal guardian, when serving as the designated provider for a minor patient, signs both authorizations on behalf of the minor patient.

WASHINGTON DC

Caregiver’s Qualification

  • Must be 18 years of age or older.
  • Must be designated by a qualifying medical cannabis patient to possess, obtain from a dispensary, distribute, and assist in administering medical cannabis.

  • Social Security Number (SSN) or an affidavit if SSN is not available.
  • Current face photo, 2×2.
  • Copy of government-issued photo ID.
  • Criminal background check report from the District’s Metropolitan Police Department (MPD) for DC residents.
  • Criminal background check report from MPD and one from the jurisdiction of residence for non-residents.

Application Fee

Fees for initial and renewal patient and caregiver registrations were waived through January 3, 2023.

$100 – Standard Fee for new card and card renewal.
$90 – Replacement Card.
$25 – Reduced fee for new card and card renewal.
$20 – Replacement card fee if applicants are eligible for the reduced fee.

WEST VIRGINIA

Caregiver’s Qualification

  • Must be 21 years or older.
  • Must be designated by a qualifying medical marijuana patient to obtain cannabis from approved dispensaries.
  • For minor patients, the caregiver must be the parent or legal guardian, designated by the patient or legal guardian, or an approved individual by the Bureau when no parent or legal guardian is appropriate or available.
  • Must not have been convicted of a criminal offense related to the felony sale or possession of drugs, narcotics, or controlled substances, or conspiracy, within the past five years.
  • Must not have a history of drug abuse or diverting controlled substances or illegal drugs.
  • Required Data
  • Patient Authorization Form as documentation of the patient’s designation of the caregiver.
  • Federal and state criminal history record information.
  • Fingerprints to obtain criminal history record checks.

Application Fee

$50 – Application fee. The bureau may waive or reduce the fee in cases of demonstrated financial hardship.

WISCONSIN
