Florida State Bill 1020
Governor Ron DeSantis signed Florida State Bill 1020 in 2019, which legalized industrial hemp in Florida under the same restrictions and guidelines as the Farm Bill, shortly after the US federal government passed the Farm Bill. The bill established a mechanism to guarantee the purity and conformity of farmed products in addition to industry regulations for the protection of consumers.
Florida also changed SB 182, which was mostly concerned with the state’s increased usage of medical cannabis products, in 2019. With the passage of this bill, Florida has made it clear that “low-THC cannabis not in a form for smoking” is exempt from all usage limitations, including those in numerous public places.
The state of Florida has a fairly clear stance on cannabinoids derived from hemp, such as delta-8-THC. “Hemp-derived cannabinoids” are not classified as restricted substances, according to Florida state law. However, the concentration of Delta-9 generated from hemp is restricted to 0.3% or less on a dry-weight basis.
As long as they adhere to specific rules on what constitutes a “legal” CBD product in the state of Florida, such as the following:
- A barcode or QR code on the label must refer to third-party batch tests for the specific product.
- THC content in CBD products cannot exceed 0.08% by volume.
- Any CBD products offered for sale in Florida must come from retailers and distributors that are authorized by the state.
