Gun Ownership and Medical Marijuana Cards In Oklahoma

Oklahoma is one of the very first US states to legalize both the medical and recreational use of marijuana for its residents.

The Oklahoma Medical Marijuana Legalization Initiative led to the development of the Oklahoma Medical Marijuana Authority (OMMA) which regulates medical marijuana licenses within the state.

In order to register yourself with the authority, you must be diagnosed with a qualifying medical condition and a permanent resident of the state of Oklahoma.

But does the state known for its progressive medical marijuana program offer legal protection to its registered medical marijuana users so they can own a gun and have a medical marijuana card in Oklahoma at the same time? Of course, yes!

The 2019 Oklahoma Statutes Title 63 clearly mentions that a medical marijuana patient’s or a caregiver’s legal right to purchase or carry a firearm, ammunition, or related accessories can’t be restricted because of their position as a registered patient or a caregiver.

That’s why, when you apply for an Oklahoma medical marijuana card, no one enquires about your gun ownership status.

Carrying a Firearm to an Oklahoma Dispensary: Is It a Good Idea?

According to the former legislation being abolished in 2019, residents of Oklahoma who are of legal age to carry a firearm can carry a concealed or open firearm without a permit.

The state however has provided the following list of places where carrying a firearm is prohibited as per the law,

  • Public bars
  • Schools/colleges/universities/technology centers
  • Courthouses
  • Legal gambling establishments (public)
  • Government buildings/offices used for public business
  • Sports venues during pro games (having public gatherings)
  • Jails and prisons

As a dispensary is not included in the list, you can legally carry a firearm there as long as you’re following the law.

Consuming CBD Products and Owning a Gun in Oklahoma

Apart from legalizing the recreational and medical use of marijuana, the state of Oklahoma also legalized CBD-products consumption. As per the law, adult residents of the state can legally possess/purchase industrial hemp-driven CBD products (oils, topicals, dietary supplements, etc.) as long as the THC content is not more than 0.3%.

As the state doesn’t require you to have a gun carry permit in most cases, you can legally consume approved CBD products and own a gun in Oklahoma at the same time.
