Patient possession limits: At any given moment, the eligible patient and the primary caregiver may share four ounces of usable marijuana.

The plant's seeds, stalks, and roots are excluded from the definition of "usable marijuana". Seven marijuana plants, mature or immature, are the maximum number that may be grown at home.

Qualifying for the medical marijuana program: To be eligible for a 329 card in hawaii, a patient must have a medical qualifying condition and a prescription from a Hawaii doctor or advanced practice registered nurse who has the authority to prescribe that the "potential benefits of the medical use of marijuana would likely outweigh the health risks for the qualifying patient."

In March 2022, the Hawaii Senate Health Committee passed Senate Bill 2718, which modified the definition of "qualifying patient" to extend access to medical marijuana given its many benefits. The bill made it easier for seniors (those 65 and over) to participate in the state's current medical marijuana program.

For recreational use, marijuana is prohibited in Hawaii, but possession of three grams or less is not a crime.
